The low end is a few months of free or cheap tools: a design app, a scheduling app and an email account on your own domain. The high end adds a paid cold-email tool, a lead database and a year of business software, plus registering a limited liability company in a state with a higher fee. Cold email and the law

Cold email to businesses is legal in the US if you follow the CAN-SPAM Act (Controlling the Assault of Non-Solicited Pornography and Marketing Act). There is no exception for business-to-business email. Use a true sender name and subject line, include your physical mailing address, give an easy way to opt out and honor it within 10 business days. Each email that breaks the rules can bring a penalty of up to $53,088. Cold texts and robocalls fall under stricter phone rules, so get consent first.

Licences, tax and other rules

You need no licence to run a marketing agency. You report profit to the IRS (Internal Revenue Service) and pay self-employment tax. Many owners form a limited liability company with their state and get a free employer number from the IRS (Internal Revenue Service). If you run influencer posts for clients, the FTC (Federal Trade Commission) requires clear ad disclosures, and its 2024 rule bans fake reviews, including ones an agency writes for a client.
